These terms explain the responsibilities and conditions that apply when using IntelliCallAI.

Important: calling and recording compliance

You are responsible for ensuring that your calls, messages, AI interactions, recordings and campaigns comply with the laws that apply to you and the people you contact. This includes obtaining required consent, providing required notices, honoring opt-outs and do-not-call restrictions, and complying with applicable automated-calling and telemarketing rules.

Calling responsibility

You control who you call and the campaigns you launch.

AI oversight

Review outputs and configure suitable human escalation.

Usage & billing

Plan limits and third-party provider charges may apply.

Account security

Protect credentials, API keys and connected accounts.

Draft review notice

This is an expanded product-specific draft based on the supplied Terms page. It is not legal advice. Confirm the operating legal entity, governing law, billing rules, provider relationships and enforceability of liability provisions with qualified counsel before publication.

1. Acceptance and scope

These Terms of Service (the “Terms”) govern access to and use of the website, hosted platform, applications, APIs, integrations and related services provided under the GoCallAgent name (the “Service”).

By creating an account, accessing or using the Service, or authorizing another person to use it, you agree to these Terms. If you use the Service for a company or other organization, you represent that you are authorized to bind that organization, and “you” includes that organization.

2. The Service and third-party dependencies

GoCallAgent provides tools for configuring AI voice agents, handling inbound calls, running outbound calling campaigns, routing return calls to configured agents, qualifying leads, supporting appointment workflows, and reviewing call records or related outputs. Features and availability depend on your plan, configuration, supported carrier, selected AI voice engine and connected services.

The Service may connect to third-party telephony carriers, SIP infrastructure, Asterisk-based systems, AI and voice providers, messaging services, calendar services, hosting providers and other integrations. These providers are separate services and may be subject to their own terms, privacy notices, usage limits, fees and availability.

You are responsible for selecting compatible providers, maintaining your third-party accounts and credentials, configuring integrations, and reviewing any provider-specific restrictions. A connection or configuration option in the interface does not guarantee that every provider, phone number, call direction, voice engine or feature is compatible with every workflow.

3. Account registration and security

You must provide accurate account information and keep it reasonably current. You are responsible for maintaining the confidentiality of your login credentials, API keys, integration tokens and other access information.

You are responsible for activities conducted through your account, including actions taken by your employees, contractors, agents and other authorized users. You must promptly notify us through an available support or legal contact channel if you suspect unauthorized access or misuse.

You must not share access in a way that bypasses plan limits, security controls or account restrictions. We may take reasonable steps to protect the Service and its users if we detect suspected compromise, abuse or security risk.

4. Acceptable use and prohibited activities

You may use the Service only for lawful business and personal purposes permitted by these Terms and your applicable plan. You must not use, or permit others to use, the Service to:

  • Place unlawful, deceptive, abusive, harassing, threatening or unsolicited communications, including unlawful telemarketing or spam.
  • Contact people without the permissions, consent or other lawful basis required by applicable law, or ignore applicable do-not-call lists, opt-outs, suppression requests or contact restrictions.
  • Impersonate a real person, business, public authority or other entity deceptively, or use a synthetic voice or AI agent in a way that unlawfully misleads callers or recipients.
  • Make calls or send messages for fraud, scams, phishing, unlawful debt collection, discrimination, exploitation or other illegal activity.
  • Record, transcribe, analyze or disclose communications without providing required notices or obtaining required consents.
  • Upload or process content that infringes intellectual-property, privacy, publicity or other rights, or that contains unlawful or malicious material.
  • Probe, disrupt, overload, reverse engineer, circumvent or compromise the Service, its security controls, rate limits, usage limits or infrastructure, except to the extent such restriction is prohibited by law.
  • Use the Service to make emergency calls or for other safety-critical purposes unless we have expressly agreed in writing that the relevant use is supported.

5. Calling, messaging and legal compliance

You are solely responsible for the calls, messages and other communications initiated, received, recorded, transcribed or otherwise processed through your account. This includes choosing who to contact, the purpose and timing of communications, the content of agent scripts and prompts, and the phone numbers and channels used.

You must determine and comply with all laws and industry requirements that apply to your activities and the people you contact. Depending on the jurisdictions and use case, these may include telemarketing and automated-calling rules, consent and call-recording requirements, do-not-call and opt-out rules, privacy and data-protection laws, consumer-protection requirements and restrictions on caller identification.

You must maintain evidence of required permissions and consent, provide legally required disclosures (including when an interaction uses AI or may be recorded), honor opt-outs promptly, maintain suppression lists where required, and ensure that your campaigns and calling practices are lawful. Laws may include, where applicable, the US TCPA and related rules, Canadian anti-spam and telemarketing requirements, and privacy or data-protection laws in other relevant jurisdictions.

GoCallAgent does not determine whether your particular campaign, script, contact list, recording practice or use of AI is lawful, and does not provide legal advice. Access to a feature does not mean that its use is permitted in every jurisdiction.

6. Customer data, prompts and content

You retain responsibility for the data, telephone numbers, contact lists, recordings, transcripts, prompts, knowledge-base materials, scripts and other content that you or your users submit to or process through the Service (“Customer Content”). As between you and us, you are responsible for ensuring that you have the rights and permissions needed to provide and use Customer Content for the purposes you configure.

You grant us and our service providers the limited rights necessary to host, transmit, process, display and otherwise use Customer Content to provide, secure, maintain and support the Service, in accordance with these Terms and the Privacy Policy.

You must not submit sensitive, confidential or regulated information unless the relevant feature and provider configuration are suitable for that information and you have completed any required legal, security and contractual assessments.

7. AI-generated outputs and human oversight

AI-generated speech, transcripts, summaries, classifications, lead scores, recommendations and other outputs may be incomplete, inaccurate, misleading, delayed or inappropriate. Outputs may depend on your prompts, knowledge-base content, integrations, selected AI provider and call conditions.

You are responsible for reviewing outputs and determining whether they are appropriate before relying on them or taking consequential action. Do not rely on AI outputs as the sole basis for legal, medical, financial, employment, emergency or other high-impact decisions.

You are responsible for configuring agent instructions, escalation rules, transfer destinations, appointment settings and other safeguards appropriate to your use case. Human-transfer and fallback behaviour depends on the supported call path and configuration. We do not currently provide automatic failover to another AI service when the selected AI service itself is unavailable.

8. Telephony, routing and service limitations

Call delivery and quality depend on carriers, phone numbers, SIP trunks, PBX configuration, internet connectivity, regional telecom rules, AI providers and other systems outside our direct control. Calls may fail, be delayed, be interrupted, experience latency or be routed differently because of these dependencies.

Number-based inbound routing depends on the phone number and its configured inbound agent. Certain configurations have additional requirements. For example, Twilio human transfer through Asterisk requires Twilio to be connected as an Elastic SIP Trunk; regular Twilio numbers that are not connected this way bypass Asterisk. Gemini agents require SIP numbers.

A configured human-transfer feature is not the same as automatic disaster recovery or AI-provider outage failover. Unless expressly agreed in a separate written service-level agreement, we do not promise uninterrupted calls, a particular answer rate, carrier redundancy, automatic failover, specific call quality or a specific uptime level.

9. Plans, usage limits and charges

Access to features may depend on the subscription plan, usage allowances, account status and other limits displayed in the Service or at checkout. You agree to pay the fees applicable to your selected plan and any additional usage or services that you order or enable.

Third-party charges may be separate from GoCallAgent subscription fees. These may include telephone numbers, carrier minutes, SIP connectivity, AI model or voice usage, messaging, hosting, payment processing and integration services. You are responsible for charges incurred through third-party accounts that you connect or control.

You must monitor your usage and configure campaigns and integrations to remain within your intended budget. Usage estimates, dashboards and provider-reported records may be delayed or differ from final provider invoices.

10. Billing, renewals, cancellations and refunds

Subscriptions may be offered on monthly, annual or other billing terms shown at the time of purchase. Unless the checkout flow states otherwise, subscriptions renew automatically for the applicable billing period until cancelled.

You may cancel future renewal using the account or billing controls made available to you, or by contacting the applicable support channel. Unless required by applicable law or expressly stated otherwise at purchase, cancellation takes effect at the end of the current paid billing period and does not automatically refund amounts already charged.

Except where required by applicable law or expressly stated otherwise, fees are non-refundable, including for partial billing periods, unused allowances, unused usage or plan downgrades. We may change plan prices or fees prospectively. Where required, we will provide notice before a price change applies to a renewal or future billing period.

Taxes, duties and similar charges may apply and are your responsibility unless the law requires otherwise. If a payment fails or remains overdue, we may restrict or suspend paid features after reasonable notice where practicable.

11. Intellectual property and feedback

The Service, including its software, design, interfaces, documentation, branding and underlying technology, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not transfer ownership of the Service to you. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your authorized subscription or access period.

You retain rights you hold in your Customer Content. You grant only the limited operational license described in these Terms. If you provide suggestions, feedback or ideas about the Service, you permit us to use them without restriction or payment, provided this does not grant us ownership of your Customer Content.

12. Privacy and data processing

Our handling of personal information is described in the GoCallAgent Privacy Policy, which forms part of these Terms by reference. By using the Service, you acknowledge that information may be processed by us and by third-party providers as described in that policy and in your configuration.

Where you use the Service to process personal information about callers, leads, employees or other individuals, you are responsible for determining your legal role and obligations and for providing required notices and obtaining required permissions. If a separate data-processing agreement is required, it must be agreed in writing.

13. Self-hosted deployments

If you install or operate a self-hosted version of the software, you are responsible for the infrastructure and environment under your control, including access management, server security, updates, backups, monitoring, retention and compliance.

Self-hosting does not necessarily mean that all data remains within your infrastructure. If you configure external telephony, AI, messaging, payment, analytics or other providers, information may be transmitted to and processed by those providers under their terms. Your responsibilities and ours may also depend on any support, managed hosting or other services separately provided.

14. Service availability, changes and support

We may update, improve, modify, restrict or discontinue features or parts of the Service. We will use reasonable efforts to communicate material changes where appropriate, but we do not guarantee that any particular feature will remain available indefinitely.

The Service is provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation, specific uptime, uninterrupted carrier connectivity, or that the Service will meet every requirement. Outages or failures may arise from maintenance, telecommunications networks, hosting, AI providers, integrations, internet connectivity, security incidents, force majeure events or other causes.

Any support commitments, service levels or availability commitments apply only if expressly stated in a separate written agreement signed by us.

15. Suspension and termination

You may stop using the Service and cancel your subscription in accordance with the billing terms. We may suspend, restrict or terminate access if you materially breach these Terms, fail to pay amounts due, create a security or operational risk, misuse the Service, violate applicable law, or expose us, providers or others to legal or regulatory risk.

Where reasonably practicable, we may provide notice and an opportunity to address the issue before suspension or termination. We may act immediately where necessary to protect people, systems, providers or legal rights, or where required by law.

Upon termination, your right to access the Service ends. You remain responsible for fees and obligations accrued before termination. Data export or deletion options, and the timing of any deletion, are subject to the features available, applicable retention requirements, backups and third-party provider policies.

16. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties, representations or conditions of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that AI outputs will be accurate, that calls will connect or complete, that every provider integration will remain available, that data will never be lost, or that the Service will be secure or uninterrupted. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

17. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss or damage, or for loss of profits, revenue, business opportunities, goodwill, anticipated savings, data or business interruption, arising out of or related to the Service or these Terms.

To the fullest extent permitted by applicable law, our total aggregate liability for claims arising out of or related to the Service or these Terms will not exceed the fees you paid to us for the Service during the three (3) months immediately preceding the event giving rise to the claim.

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability to the extent such limitation is prohibited by applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless us, our affiliates, and our respective officers, directors, employees and agents from third-party claims, liabilities, damages, losses and reasonable expenses arising from or related to your Customer Content, your use of the Service, your calls or messages, your failure to obtain required rights or consents, your violation of these Terms, or your violation of applicable law or third-party rights.

We will provide reasonable notice of a claim for which indemnification is sought and reasonable cooperation at your expense. You may not settle a claim in a way that imposes an admission, obligation or liability on an indemnified party without that party's prior written consent.

19. No partnership or agency

These Terms do not create a partnership, joint venture, franchise, employment, fiduciary or agency relationship between you and us. You do not have authority to make commitments on our behalf. You are responsible for your own business operations and for the communications made through your account.

20. Governing law and disputes

The original terms supplied for this page specify the laws of India as the governing law, without regard to conflict-of-law principles. This provision must be confirmed against the legal entity operating GoCallAgent, the intended customer markets and any mandatory consumer or privacy laws before publication.

Any dispute-resolution venue, courts or arbitration process should be specified in the final approved terms and must be consistent with applicable law.

21. Changes to these Terms

We may revise these Terms from time to time. The revised version will be posted on this page with an updated effective date. Where required by law, or where a change materially affects your rights or obligations, we will provide notice through an appropriate channel. Your continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by applicable law.

22. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent possible. A failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign or transfer these Terms or your account without our prior written consent, except where such restriction is prohibited by law. We may assign these Terms as part of a merger, reorganization, sale of assets or similar transaction.

These Terms, together with the Privacy Policy and any order form or separate written agreement that applies to your account, form the agreement between you and us concerning the Service. If a separate signed agreement conflicts with these Terms, the separate agreement controls for the subject matter it expressly covers.
